The petitioner seeks bail in a case instituted for the offences under Sections 307, 326, 27 of the Indian Penal Code and 27 of the Arms Act..

The prosecution case in short is that the accused persons shot fire on the informant due to which he sustained fire arm injury.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 5.9.2018. There is no allegation of tampering of witnesses alleged against the petitioner. Chargesheet has been submitted in the present case. The petitioner has falsely been implicated in the present case. The petitioner is not

Patna High Court CR. MISC. No.14194 of 2019(3) dt.11-04-2019 2/2 named in the F.I.R. There is no substantive evidence to suggest his implication in the present case except for the confessional statement of the petitioner in course of investigation. There is no recovery of any incriminating article from the possession of the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-V, Katihar in connection with Sessions Trial No. 455 of 2018 arising out of Katihar Sahayak P.S. Case No. 447 of 2018.
