02. 13.07.2017 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in a case registered for offences under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 239 litres of foreign liquor were recovered from the Commander Jeep which was being boarded by two persons including the petitioner who tried to escape but petitioner was apprehended on chase. Petitioner claims that he is having clean antecedent and is in custody since 05.06.2017.

Having regard to the facts and the circumstances of

Patna High Court Cr.Misc. No.32584 of 2017 (2) dt.13-07-2017 the case, the petitioner, above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-VI, Saran at Chapra in connection with Baniapur P.S. Case No. 142 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
