The petitioners seek bail in anticipation of their arrest in connection with Tekari P.S. Case No. 50 of 2020 dated 08.02.2020 instituted for the offences under Sections 341, 323, 307, 354, 379, 427, 504/34 of the Indian Penal Code and Section 3⁄4 of the Dyne Act.

It has been alleged in the F.I.R. that the petitioners along with others assaulted the Informant and divested her of personal belongings on the charge of her practicing sorcery in the village. It has also been alleged that the accusation is general and omnibus and the case has been lodged only in retaliation to the case filed by one of the accused persons of this case against the Informant of the

Patna High Court CR. MISC. No.24481 of 2021(2) dt.25-05-2022 2/2 subject F.I.R.

The learned counsel for the petitioners has submitted that the parties are neighbors and there was some dispute between them but, the accusation in this case has been overtly exaggerated. Some of the accused persons of the counter case have been granted anticipatory bail.

Considering the futility of the accusation against each other, the parties have decided not to prosecute each other which fact has been noted in this bail petition.

Considering the aforenoted submissions, the petitioners are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VI, Gaya in connection with Tekari P.S. Case No. 50 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) rishi/- U T
