Petitioners, already in custody, seek bail in connection with S.G.R. Case No.36 of 2016, arising out of Chanpatia P.S. Case No.202 of 2016, registered under Sections 363, 366(A), 302 and 120(B) of the Indian Penal Code as well as under Section 8 of the Protection of Children From Sexual Offences Act. Allegation in brief is that suspicion was raised that the informant's daughter was kidnapped by Guddu Kumar with the help of other accused and perhaps she was murdered. Learned counsel for the petitioners submits that the girl is still alive and her statement was recorded under Section 164 Cr.P.C. wherein she admits that she eloped away with one
Patna High Court Cr.Misc. No.6832 of 2018(2) dt.05-02-2018 2/2 Jaihind Yadav and married with him and only on suspicion, Guddu Kumar with whom she once eloped away earlier, his father and brother, the petitioners, were implicated in this case. Having considered the said facts and circumstances, petitioners Mofil Das and Manoj Das are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-1st,-cumSpecial Judge, Bettiah, District West Champaran in connection with S.G.R. Case No.36 of 2016, arising out of Chanpatia P.S. Case No.202 of 2016.
