The petitioner apprehends his arrest in connection with Nardiganj P.S. Case No.02 of 2020, registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

The petitioner along with other co-accused persons are said to have killed the husband of the informant. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is further submitted that during investigation the informant has not taken the name of the petitioner. The petitioner has got no criminal antecedent.

Learned APP for the State as well as learned counsel

Patna High Court CR. MISC. No.24559 of 2021(3) dt.28-06-2022 2/2 for the informant opposed the prayer for anticipatory bail of the petitioner and submitted that prayer for anticipatory bail of one co-accused, Ganesh Singh has been rejected by a co-ordinate Bench of this Court vide order dated 23.07.2021, passed in Cr. Misc. No.2849 of 2021.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
