Petitioner seeks bail in a case registered for the offences punishable under Sections 326 A, 459, 460 and 307/34 of the Indian Penal Code.
Allegation against the petitioner is that he threw acid and caused burn injury at the cervical region of Meena Devi. The occurrence allegedly took place for land dispute. The petitioner is in custody since 20.07.2016. The petitioner was earlier refused bail by this Court in Cr.Misc.No.49127 of 2016 on 23.01.2017 with liberty to renew prayer after completion of one year in custody, if the trial is not concluded, in the meantime.
Patna High Court Cr.Misc. No.42448 of 2017 (3) dt.11-10-2017 The report of the learned Trial Judge dated 18.09.2017 would reveal that the trial is likely to be concluded within next six months. However, the depositions of three prosecution witnesses including the injured would reveal that none of them have supported any allegation against the petitioner.
In the circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Pakridayal Police Station Case No. 97 of 2015 , subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
