JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-03-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Amas P.S. Case No. 34 of 2018 registered under Sections 272 and 273/34 of the Indian Penal Code and Section 30(a) of the Excise Act.

The accusation is of recovery of 70 litres liquor kept in a gunni bag from the motorcycle, which was driven by Deepak Choudhary and this petitioner was found sitting on the motorcycle. Learned counsel for the petitioner submits that petitioner has no criminal antecedent and is in custody since 01.02.2018.

Having regard to the facts and the circumstances of

Patna High Court Cr.Misc. No.16903 of 2018 (2) dt.28-03-2018 the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Excise Judge, Gaya, in connection with Amas P.S. Case No. 34 of 2018.
