The petitioner seeks bail in Katihar Town ( Sahayak ) P. S. Case No. 597 of 2018 instituted for the offence under Section(s) 394, 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for petitioner submits that FIR is against unknown. No T.I.P. has been held. Police apprehended the petitioner merely on suspicion from his house and thereafter recorded his confessional statement. In the written report, it is alleged that while the informant along with her sister Priyanka Kumari was returning from Mirchaibari market on 25.8.2018 at 6.30 PM and when they reached near house of Pappu Pandit, two boy from behind

Patna High Court CR. MISC. No.14400 of 2019(4) dt.28-05-2019 2/2 came and snatched mobile from Priyanka Kumari and when they made protest, it is alleged that that one of accused person fired on the temple of Prinyanka Kumari and fled away. Subsequently, the sister of the informant died on way to hospital.

The case diary has been received. From perusal of the case diary, it appears that no T.I.P. has been held till date. The police has recorded the confessional statement of this petitioner after apprehending him on suspicion.

Petitioner is in custody since 27.8.2018.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge-VI, Katihar, in connection with Katihar Town ( Sahayak ) P. S. Case No. 597 of 2018, Sessions trial no. 457 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner.
