JUSTICE ARUN KUMAR ORAL ORDER 02-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Muffasil PS Case No. 213 of 2016 registered under Sections 323, 307, 386 and 34 of the IPC.

The allegation in brief is that there was an altercation with informant's brother, a shop keeper, with one of the customers Ali Mian and he had threatened his brother and in the early morning he was assaulted by stone or by some weapon on his head. Demand of extortion of Ten lakh rupees was also made and one page was found lying there making demand of extortion.

Learned Counsel for the petitioner submits that without any material the petitioner has been shown as member of Royal group, there is no such group and he is not named in the FIR. The altercation took place with one Ali Mian and only suspicion was raised by the informant against the petitioner. Ali Mian has been admitted to bail. Kunal Jha, also a member of the so called gang, too has been admitted to bail. The police has submitted charge-sheet against the petitioner and he is in custody since 6.6.2017. Patna High Court Cr.Misc. No.6118 of 2018 (2) dt.02-02-2018 petitioner, namely, Sonu Patel is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Bettiah West Champaran in connection with Muffasil PS Case No. 213 of 2017, with the condition that one of the bailors shall be a close family member of the petitioner.

The petitioner is directed to appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of medical emergency his bail bonds shall be liable to be cancelled.
