JUSTICE SANJAY PRIYA ORAL ORDER 01-08-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Town P.S. Case No.276 of 2017 instituted for the offences under sections 30A of Bihar Prohibition and Excise Act, 2016.

It is alleged in the written report by the informant that he along with other police officers after search of the rented house of the petitioner, recovered total 130 liters of Royal Stag foreign liquor in the ground floor of second room beneath the bed in which 96 pieces of 750 ml. and 74 pieces of 180 ml of Royal stag foreign liquor and from the dickey of Alto Maruti car, 48 bottles of 750 ml and 24 pieces of 375 ml liquor were recovered. No.35459 of 2017 (2) dt.01-08-2017 2/2 further alleged that the said Maruit car was standing in side the room and one female member aged about 13 years has told that liquor belongs to his father Ajay Kumar @ Munna and on the seizure list there is no signature of the daughter of the informant. It is mentioned in para-3 of this application that the petitioner has clean antecedent and he is in custody since 11.06.2017.

In the facts and circumstance of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 7th cumSpecial Judge, Bihar Prohibition and Excise Act, 2016, Begusarai in connection with Town P.S.Case No. 276 of 2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
