1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Forest Case no. 60F of 2023 registered under sections 2, 33, 41, 42 and 52 of the Indian Forest Act and sections 2, 27, 29, 31 and 51 of the Wild Life Protection Act.

3. As per the prosecution case, on secret information having been received, a raid was conducted and it is stated that three 'SAL' logs and one 'SAL' sheet were recovered from the house of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case because of his antecedent. No incriminating article has been recovered from

Patna High Court CR. MISC. No.22058 of 2024(2) dt.04-04-2024 2/2 his possession or from his premises. The petitioner is in custody since 21.9.2023 and charge-sheet has been submitted in the case.

5. The application for bail is opposed by learned A.P.P for the State.

6. Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, the penalties under the Indian Forest Act, 1927 as also the Wildlife (Protection) Act, 1972 together with the petitioner having remained in custody for more than 6 months since 21.9.2023 and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Forest Case no. 60F of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran.
