The petitioner in the present case is seeking pre-arrest bail in connection with Ara (Nawada) P.S. Case No. 774 of 2020 registered for the offences punishable under Sections 406/420 of the Indian Penal Code.

There is a wrong statement in paragraph '3' that the petitioner has got no criminal antecedent whereas the facts appearing from the impugned order would show that earlier the petitioner was arrested in connection with one case. He has not disclosed this.

Further, it appears from the impugned order that the petitioner was one of the persons who was involved in alluring the persons in the name of providing them job in Railways. A sum of Rs.5 lakhs was received by him in his account which

In the kind of the materials present in this case and the seriousness of the allegations as also suppression of criminal antecedent by the petitioner, this Court is of the considered opinion that he does not deserve privilege of pre-arrest bail. The prayer for anticipatory bail of the petitioner is, thus, refused.

The application stands dismissed.
