Patna High Court Cr.Misc. No.46665 of 2014 (02) dt.20-04-2015 2/3 02/ 20-04-2015 Heard learned counsels for the petitioners and the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 363 and 366A/34 of the Indian Penal Code. The accusation is of kidnapping the minor daughter of the informant by one Sakaldeo Sharma though the petitioners and others alleged to have conspired with Sakaldeo Sharma.

It is submitted by learned counsel for the petitioners that first accusation is against Sakaldeo Sharma and only suspicion has been raised against the petitioners and others. Petitioner Shyam Malakar is a practicing lawyer. A statement has been made in para 3 of both the petitions that the petitioners have no criminal antecedent and for the occurrence of 05.04.2014 the FIR was registered on 09.04.2014. Considering the delayed lodging of the case and the suspicious nature of accusation coupled with the statement that the petitioners have no criminal antecedent, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail

Patna High Court Cr.Misc. No.46665 of 2014 (02) dt.20-04-2015 3/3 bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Muffasil P.S. Case No. 125 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
