The petitioner is languishing in custody since 03.12.2017 in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code. The prosecution case is that the petitioner has took Rs. 60,000/- per candidate from the petitioner and his seven friends for providing them employment in Welfare Department. It is submitted by learned counsel for the petitioner that there is no material on record with regard to payment of the alleged amount to the petitioner. It is further submitted that the
Patna High Court CR. MISC. No.13391 of 2019(2) dt.07-03-2019 2/2 investigation has already been concluded. A statement has been made in paragraph no.3 of the petition that the petitioner is also involved in one other case, apart from the present case, in which he is on bail.
Learned APP for the State submits that there is specific accusation against the petitioner.
Considering the fact that there is no material on record with regard to alleged payment made to the petitioner and the fact that the investigation has already been concluded, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Civil Court Patna in connection with Gandhi Maidan P.S. Case No.341 of 2017.
