The petitioner apprehends his arrest in a case registered for the offence under Sections 272, 273 of the I.P.C. and Section 30(a) of Bihar Prohibition and Excise Act. 54 liters of country-made liquor has been recovered from the bank of river and petitioner has been identified by the chowkidar while he was fleeing away from the place of recovery.
It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Recovery has been made from an open field and petitioner has been made accused in this case only on suspicion. Petitioner has got clean antecedent.
