====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-10-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 379, 302/34 and other ancillary sections of the Indian Penal Code. As per the prosecution case, petitioner and other accused persons abused the informant. Co-accused Chandeo Rai assaulted the informant with iron rod on his head, Badrinath Rai hit him by stick and when informant's father came in rescue he was assaulted with bricks by Dipak Rai.Co-accused persons assaulted the informant, while petitioner is alleged to have snatched gold locket from the neck of the informant. It is further alleged that accused persons entered the house of the informant and co-accused Monu Kumar outraged the modesty of the elder sister-in-law of the informant. Informant's father

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No specific overt has been alleged against the petitioner. Petitioner is not the assailant of the deceased. He is in custody since 21.10.2020.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate I, Danapur, Patna in Bihta Police Station Case No. 567 of 2020.
