The petitioners seek bail in connection with Fatehpur P.S. Case no. 359 of 2017 registered under Sections 272, 273, 34, 414 of the Indian Penal Code and Section 30(a) of the Bihar Excise and Prohibition Act 2016.
85 lts. of country made liquor is said to have been recovered from the motorcycle of the petitioners and petitioners and one another accused were apprehended.
It is submitted by the learned counsel for the petitioners that no incriminating article has been recovered from their conscious physical possession. Petitioners have no concern
Patna High Court Cr.Misc. No.6749 of 2018(2) dt.19-02-2018 2/2 either with the aforesaid motorcycle or with the seized liquor. They have been falsely implicated in the case. They have no criminal antecedent. They have been languishing in custody since 09.10.2017.
In the facts and circumstances of the case, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge of Excise Act, Gaya in connection with Fatehpur P.S. Case no. 359 of 2017.
