The petitioner seeks bail in a case registered for offences under Sections 47(a), 48(2), 49, 54 and 63 of the Bihar Prohibition and Excise (Amendment) Act, 2016. It is contended that as per allegation, 275 litres spirit were allegedly recovered from the Maruti Omni vehicle which is said to be driven and owned by the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 06.05.2017.

Considering the facts and the circumstances of

No.39248 of 2017(2) dt.19-08-2017 2/2 the case, the petitioner, above named is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Gaya in connection with Barachati P.S. Case No. 241 of 2017 with a condition that one of the bailors will be the resident of Bihar since the petitioner belongs to Jharkhand. Further, if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
