The petitioner, who is in custody since 21.11.2019 and is the driver of the pick-up van from where 855.36 litres of liquor has been recovered, seeks bail in connection with Special Case No. 10421 of 2019 (arising out of Bakhatiyapur P. S. Case No. 358 of 2019) instituted for the offences under Section 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner has submitted that the petitioner was merely asked to drive

Patna High Court CR. MISC. No.13242 of 2020(2) dt.02-03-2020 2/2 the pick-up van without letting him know the contents of consignment. The petitioner did not have any reason to suspect that he was being made to transport liquor, as three of the owners of the pick-up van were also escorting him.

The petitioner has clean antecedents.

Considering the aforesaid facts, viz, the period of custody of the petitioner and his clean antecedents, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise) Act, Patna in connection with Special Case No. 10421 of 2019 (arising out of Bakhatiyapur P.
