JUSTICE PURNENDU SINGH ORAL ORDER 26-11-2021 Heard learned counsel appearing on behalf of the petitioner as well as learned Additional Public Prosecutor appearing for the State through video conferencing. Learned counsel appearing on behalf of the petitioner submits that vide order dated 23.09.2021 passed in Cr. Misc. No.25462 of 2021 petitioner was released on provisional bail by this Court. It is the submission of the petitioner that informant who is a tenant in the house of the petitioner has implicated him in a false case and earlier also he was made an accused in Bhorey P.S. Case No.181 of 2020 and in that case petitioner is on bail. It is further submitted on behalf of the petitioner that in the present case he has been made accused just to harass him. The aforesaid fact has already been taken note by this Court in order dated 23.09.2021.
Learned APP on behalf of the State submits that
Patna High Court CR. MISC. No.25462 of 2021(3) dt.26-11-2021 2/2 nothing has come in the case diary, however, in paragraph no.6 and 5 which relates to statement of the informant of the case. Having considered the submissions made by the parties and the allegations made in the FIR and also considering that the petitioner has already been released on provisional bail, let the petitioner surrender before the court below and if the petitioner is so advised for regular bail, the court below after being satisfied may release the petitioner on the same day after considering the facts and circumstances and materials on record, may release the petitioner on regular bail on such terms and conditions as fixed by the court.
Learned counsel appearing on behalf of the petitioner submits that he undertakes that petitioner will not hindered the progress of trial. Let the court below expeditiously concluded the trial.
