JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-08-2017 The petitioner seeks regular bail in connection with Barhara (Sinha O.P.) P.S. Case No. 183 of 2016, registered for offences punishable under Sections 302/201 of Indian Penal Code. Allegation against the petitioner and other accused is of causing death of the deceased.
It has been submitted on behalf of the petitioner that is not named in the F.I.R, later on his name transpired in this case only on the basis of confessional statement of co-accused and except that there is nothing against the petitioner so as to show his involvement in commission of the said offence. He has been in judicial custody since 03.06.2017.
Learned counsel for the State opposed the prayer for bail. Having heard both sides, considering the fact and
Patna High Court Cr.Misc. No.32517 of 2017 (3) dt.02-08-2017 circumstances of the case and nature of allegation, at this stage, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.
However, the petitioner may renew his prayer for bail after framing of charge in this case.
