JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-05-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No.470 of 2018 disclosing offences under Sections 323, 498A, 379/34 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act. Allegation as per complaint petition against the petitioner is that petitioner has demanded rupees one lac and a motorcycle and for that assaulted her and tortured her both mentally and physically.

It appears from the record that on appearance of the complainant the case was referred to the mediation center for reconciliation, but the mediation center has failed to resolve the dispute in spite of the best efforts taken by the mediator.

No.13819 of 2019(3) dt.09-05-2019 2/2 Submission of the learned counsel for the petitioner is that petitioner is ready to keep the opposite party no.2, but at present he is residing in his brother's house. Heard learned A.P.P. as well as learned counsel for the opposite party no.2. Learned counsel for the opposite party no.2 has submitted that she is still ready to reside with him, if the petitioner live separately from the house of his Bhabhi. Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.

25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of Sub Divisional Magistrate, Aurangabad, in connection with Complaint Case No.470 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. This is further subject to the condition that he has to cooperate with the disposal of the trial and appear before the court as and when required.
