ANJANA MISHRA ORAL ORDER 21-02-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 15.09.2017 in connection with Nath Nagar (Madhusudanpur) P.S. Case No.403 of 2017 registered for the offence under Section 364A/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner was taken into custody on the basis of the confessional statement made before the police, which has no evidentiary value. He further submits that on the same day, the victim boy was recovered and no recovery was made from the possession of the petitioner nor he has been placed on T.I. Parade.

No.5855 of 2018 (3) dt.21-02-2018 2/2 Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bhagalpur, in connection with Nath Nagar (Madhusudanpur) P.S. Case No.403 of 2017.
