JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-07-2015 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Amarpur P.S. Case No. 48 of 2015 (G.R. No. 287 of 2015) registered under Sections 366(A), 504 and 506/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that it would appear form the F.I.R. that Neha Kumari, daughter of informant, Subhash Mandal, moved from her house on 07.02.2015 and boarded in the Tempo, which was seen by the nephew of the informant, thereafter informant started to search and came to know that Sumit Rajak, son of Late Rudeo Rajak, had kidnapped his

Patna High Court Cr.Misc. No.18379 of 2015 (3) dt.02-07-2015 daughter with intention to marriage. It is also alleged that there was usual talk on mobile of his daughter with sister of Sumit Rajak. Learned counsel for the petitioners further submits that, in fact, there was love affairs in between Neha Kumari, daughter of informant and Sumit Rajak but the petitioners, who are mother, sister and brothers of Sumit Rajak, have falsely been implicated in this case due to ulterior motive. In fact, Neha Kumari and Sumit Rajak performed the marriage and used to reside at Bhagalpur. Considering the aforesaid submissions, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.

10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka, in connection with Amarpur P.S. Case No. 48 of 2015 (G.R. No. 287 of 2015), subject to the condition as laid down under Section 438(2) of the Cr.P.C.
