Petitioner seeks bail in a case registered for the offences punishable under Sections 364, 364A, 384, 386 and 506/34 of the Indian Penal Code.

The FIR named accused persons allegedly kidnapped to Raghu Kumar the son of the informant. Petitioner is not named in the FIR. Name of the petitioner surfaced in the confessional statement of co-accused Vishal Kumar. Petitioner has stated on oath that he has got no criminal antecedent. He is in custody since 23.11.2018. Investigation against the petitioner is complete. He was never put on Test Identification Parade during investigation.

Learned counsel for the informant opposed the prayer

Considering the aforesaid facts of this case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kanti (Panapur O.P.) Police Station Case No. 486 of 2018, with the following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below having immovable property.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Rajan/- U T
