JUSTICE BIRENDRA KUMAR ORAL ORDER 15-03-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 30(a),41(i) of Bihar Prohibition and Excise Act 2016. From a car, liquor was recovered by the police and it was informed that the petitioner was there who fled away. Petitioner has got an identical criminal antecedent, wherein allegation was that from the house of the petitioner, 11 liters of liquor was recovered.

Contention is that the house is jointly occupied by the family members. In the present case, neither the car

Considering the criminal antecedent of the petitioner, I am not inclined to enlarge him on anticipatory bail in connection with Siwan (Nagar) P.S.Case No.613 of 2018 pending in the court of learned Additional Sessions Judge-IIcum-Special Judge, Excise, Siwan. Accordingly, prayer is refused.
