JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-06-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 366A of the Indian Penal Code.

The accusation is of kidnapping the minor daughter of the informant.

It is submitted by learned counsel for the petitioner that the victim is major and she has performed marriage with the petitioner and both are residing together. The present application has been affidavitted by the victim girl.

Considering the aforesaid facts, let the above named petitioner be released on provisional anticipatory bail for three months, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail

Patna High Court Cr.Misc. No.20944 of 2015 (2) dt.23-06-2015 2/2 bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Gaya in connection with Tekari P.S. Case No. 162 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. The petitioner undertakes to produce the victim girl on 20th of July, 2015 when the learned court below will record the statement of victim girl and if the victim girl admits that she of her own married with the petitioner then the provisional bail of the petitioner will be confirmed otherwise the petitioner will surrender and pray for regular bail.

If the petitioner files an application with a prayer for security, it is expected from the learned CJM, Gaya to intimate the police authorities in advance for giving adequate protection to the petitioner and victim girl for appearance in the court. Let the order be transmitted to the learned CJM, Gaya and the concerned magistrate.
