This is an application for bail in connection with Belaganj P.S.Case No. 131 of 2017 registered for the offences punishable under Section 379 of the Indian Penal Code. Petitioner is not named in the FIR and allegation is with regard to theft of vehicle and thereafter demand of money for release of vehicle.
Submission of learned counsel for the petitioner is that he has been made accused only on the basis of suspicion and there is nothing against him and he has no criminal antecedent. Further submission is that he is in custody since 25.7.2017 in this case. Heard learned APP also.
Having heard both sides and in view of the fact that
Patna High Court Cr.Misc. No.45373 of 2017 (3) dt.10-10-2017 2/2 petitioner has no criminal antecedent and there is no specific allegation against him, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-XI, Gaya, in connection with Belaganj P.S.Case No. 131 of 2017, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties in the jurisdiction of court concerned, (2) Petitioner shall co-operate in trial and appear on each and every date fixed in court and failure to appear on two consecutive dates without any genuine reason or without permission of court, his bail bond shall be liable to be cancelled.
