Mr.Md. Iftekhar Mahmood ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-03-2019 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Excise Case No. 1505 of 2018 arising out of Barahara P.S. Case No. 373 of 2018 for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of 3 liters of illicit liquor from the motorcycle. The name of the petitioner appears to have transpired in the present case upon disclosure made by the four apprehended accused persons, who are said to have disclosed that the petitioner was engaging in business of illicit liquor, however, upon raid having been made at the house of the petitioner, no illegal articles or illicit liquor was recovered.

It is further submitted that though the petitioner is accused in five other cases, but he is on bail in four of them. The petitioner is languishing in custody since 22.09.2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned 4th Additional Sessions Judge, Bhojpur at Ara in connection with Excise Case No.1505 of 2018 arising out of Barahara P.S. Case No. 373 of 2018.
