The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 323, 307, 504 & 506/34 of the Indian Penal Code and later on 302 IPC was added. The husband of the informant is said to have been called and killed by petitioner and other co-accused by severely assaulting him.
It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He is quite innocent and has been falsely implicated in this case by the informant without any concrete evidence. There is no eye witness of the occurrence nor any motive has been assigned against the petitioner. The entire story has been cooked up by
Patna High Court CR. MISC. No.24341 of 2021(3) dt.28-10-2021 2/2 the informant after due deliberation with the help of enemical person of the petitioner. No incriminating article has been recovered from his conscious physical possession. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. The petitioner has no criminal antecedent and has been languishing in custody since 17.12.2020.
Learned APP for the State opposed the bail petition.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Mokama P.S.
