ANJANA MISHRA ORAL ORDER 23-07-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is apprehending his arrest in connection with Complaint Case No.3121 of corresponding to Awatar Nagar P.S. Case No.166 of 2014 for allegedly having committed the offence under Sections 364, 379 and 120B of the Indian Penal Code.

Learned counsel for the petitioner submits that the allegation if at all is against the Nahiar people of the victim lady Mana Devi. Learned counsel further submits that the specific allegation is against other persons whereas just a bald allegation has been made in the complaint petition that this petitioner wants to kill the informant and take away all his

Considering the nature of the allegations made in the complaint petition and also that the said case has been registered after long span of time and that the petitioner has no criminal antecedents, let the above named petitioner, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Pradeep Kumar Choudhary, learned Judicial Magistrate, Saran at Chapra, in connection with Complaint Case No.3121 of corresponding to Awatar Nagar P.S. Case No.166 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
