The petitioner apprehends his arrest in Triveniganj P.S. case No. 212 of 2015 registered under Sections 302/34 of the Indian Penal Code.

The informant, father of the deceased, alleged that his son went to village Bhura to participate in a Panchayati but his son did not return. The dead body of his son was found and the informant suspected that petitioner along with other accused persons might have killed his son.

It is submitted by the learned counsel for the petitioner that informant is not an eye witness of the occurrence. Nobody has come forward to say that petitioner killed the deceased. Witnesses have stated that the deceased was sitting on

Considering the facts aforesaid and the fact that save and except suspicion there is no material against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Supaul in Triveniganj P.S. Case No. 212 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
