ANJANA MISHRA ORAL ORDER 01-02-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 5.8.2017 in connection with Gwalpara P.S. Case No.59 of 2015 registered for the offence under Sections 353, 395 and 397 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has been implicated in connection with the present case on the basis of the confessional statement made before the police, which has no evidentiary value. He further submits that other similarly situated co-accused have been extended the privilege of regular bail in Cr.Misc. No.30682 of 2017, vide order dated 21.07.2017, and Cr.Misc. No.62825 of 2017, vide

Patna High Court Cr.Misc. No.5449 of 2018 (2) dt.01-02-2018 2/2 order dated 11.01.2018.

Considering the aforementioned facts and circumstances and that there was no recovery from the possession of the petitioner, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shree Shiv Kumar, learned J.M.-1st Class, UdaKishunganj, District-Madhepura, in connection with Gwalpara P.S. Case No.59 of 2015.
