2. The petitioner is seeking regular bail in connection with Rajoun P.S. Case No. 100 of 2022 for the offences punishable under Sections 341, 323, 366(A), 504, 506/34 of the Indian Penal Code and Section 4 of the POCWO Act and later on 376, 366 of the IPC was also added.
3. As per allegation, the informant's daughter went out from her house to attend the call of nature but she did not return. On search, it came to light that the petitioner has kidnapped the daughter of the informant.
4. Learned counsel for the petitioner submits that the statement of the victim under Section 164 of the CrPC has been
Patna High Court CR. MISC. No.20818 of 2024(4) dt.01-07-2024 2/2 annexed with the case diary, which shows that she did not level allegation against the petitioner. He has further submitted that she solemnized her marriage with the petitioner and she has a child from the petitioner. He has also submitted that the petitioner is under custody since 01.09.2022.
5. On the other hand, the learned APP for the State has opposed the prayer for bail.
6. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Rajoun P.S. Case No. 100 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
