JUSTICE ARUN KUMAR ORAL ORDER 20-07-2017 Heard learned counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Complaint Case No.790 of 2015 registered under Sections 498 (A), 323/34 of the Indian Penal Code and Section 3⁄4 of the dowry Prohibition Act.
Allegation in brief is that after marriage solemnized in the year 2015 she was ousted as the further demand of dowry was not fulfilled.
Learned counsel appearing on behalf of the petitioner submits that in fact before this complaint case earlier a complaint was filed by father of the petitioner. The wife of the petitioner was suffering from serious illness suppressing this fact marriage was
Patna High Court Cr.Misc. No.34024 of 2017 (2) dt.20-07-2017 2/2 solemnized so in this regard, the complaint was filed and he has been in custody since 10.4.2017.
Having considered the said facts and circumstances, the petitioner, namely, Prakash Kumar @ Anandi Prasad Gupta is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bikramganj, Rohtas in connection with Complaint Case No.790 of 2015.
