Mr.Awadhesh Kumar Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 29-04-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 147/148/149/ 188/ 189 / 307/353/124A of the Indian Penal Code and Section 27 of the Arms Act.

Police got information that the Maoists are going to commit some bigger crime when the police raid firing and counter-firing took place. The petitioner and others were named on the basis of suspicion.

Submission is that the petitioner was in custody in some other case since 11.06.2016 and from that case the petitioner was remanded in this case on 11.06.2018.

Patna High Court CR. MISC. No.16071 of 2019(2) dt.29-04-2019 2/2 Investigation of the case is complete. There is no direct and substantial material against the petitioner. Some other coaccused has been allowed bail by a coordinate Bench of this Court in Cr. Misc. No.14173 of 2019.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Deo P.S. Case No.77 of 2014, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below having immovable property in his name.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
