In this application, the petitioner apprehends his arrest for the offences punishable under Sections 302 /34 of the IPC. Allegedly the petitioner and others assaulted the informant and when he became injured, the petitioner and others caught and assaulted Savita, daughter of the informant and when she was going, on the order of Bhabhi (Fula Devi), Ranju and

Patna High Court Cr.Misc. No.19565 of 2015 (3) dt.09-07-2015 2/2 Kanju threw her down resulting Savita died.

Submission is of false implication and that due to previous dispute between the children, wherein, Savita died but the petitioner and his wife have also been implicated in this case. The wife of the petitioner has been allowed pre arrest bail by another Bench of this court vide order dated 17.12.2014 passed in Cri. Misc. No. 13727 of 2014 and the case of the petitioner is on better footing, to which learned A.P.P. does not oppose. In the facts and circumstances stated above, the petitioner Parmeshwar Prasad @ Parmeshwar Raya in case of his surrender or arrest within one month from the date of receipt or production of the order he shall be released on bail on execution of bail bond of Rs 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Patna City in connection with Gauri Chak P.S. Case No. 291 of 2013 subject to the conditions as laid down in Section 438(2) of the Cr.P.C.
