JUSTICE ARUN KUMAR ORAL ORDER 26-03-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody since 08.12.2017 seeks bail in connection with Hilsa P.S.Case No. 747 of 2017 registered under Sections 323, 341, 354B and 504/34 of the Indian penal Code.

Allegation in brief is that informant had gone to washroom but the accused persons objected and also assaulted and the petitioner is said to have outraged her modesty. Submission is that both sides live in the same house, they are agnates and petitioner is none but the elder brother of the husband of the informant and due to partition dispute petitioner has been implicated in this case.

Having considered the aforesaid facts and circumstances,

Patna High Court Cr.Misc. No.17304 of 2018 (2) dt.26-03-2018 2/2 the petitioner, namely, Banaras Pandey @ Vanaras Pandey @ Jitendra Pandey, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM, Hilsa, Nalanda at Biharsharif in connection with Hilsa P.S. Case No. 747 of 2017 (GR No. 2384 of 2017).
