2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 406, 409, 34 of the Indian Penal Code.

3. As per FIR, it is a case of non-compliance of Mukhyamantri Payjal Yojana and Gali Nali Pakkikaran Yojana for the fianncial year of 2017-18. It is further alleged that the petitioner is involved in this financial embezzlement of Govt. fund.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. The petitioner is Ward Secretary of Gram Panchayat Raj Wari Ward No-3 and due to which she has falsely been implicated in this present case. During investigation, local

Patna High Court CR. MISC. No.17537 of 2024(2) dt.14-03-2024 2/3 Mukhiya Jagar Nath Poddar stated that Gali Nali Pakkikaran Yojana work has been completed by the petitioner. It also came into light that 80% work of Mukhmantri Payjal Yojana has also been completed and remaining amount i.e. 2,34,000/- is in her bank account out of total allotted amount i.e. 5,14,318/-. It is further submitted that the petitioner has got no criminal antecedent. Moreover, she is languishing in judicial custody since 30.11.2023.

5. Learned APP appearing for the State has vehemently opposed the prayer of Bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as judicial custody and being lady, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Singhiya P.S. Case No. 182 of 2020 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Rosera Samastipur.
