The petitioner seeks bail in a case registered for the offence punishable under Section 401, 420, 414 and 467/34 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.
Petitioner along with three other accused persons were apprehended in the car and they are said to have handed over 19 cartoons of liquor to one Daulat Singh on the way by diverting the route seeing the police party.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner or the car. He has

No.23990 of 2018 (02) dt.30-04-2018 2/ 2 been falsely implicated in this case by the police merely on suspicion while he was passing through the place of occurrence at the time of occurrence. He has no concern either with the seized liquor or the car in question. The seized car is hailing to one apprehended accused Vikki Kumar. Though one more criminal case has been lodged against him but he has been acquitted in the said case. He has been languishing in custody since 02.02.2018. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-IV-cum-Special Judge, Darbhanaga in connection with Simari P.S. Case No.11 of 2018.
