The petitioner is accused in connection with Sitamarhi P.S. Case No. 1119 of 2017 registered under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.
The accusation is that, on receiving secret information about concealing the illicit liquor in the Circus compound near Ambedkar Chouck, the informant along with other police officials reached there for verification. At that time, two persons tried to flee away, but both apprehended, who disclosed their names as Shiv Shankar Singh and Kumar Manish (petitioner) and on their disclosure, 150 bottles each containing 300 ml and 600 bottles each containing 180 ml, Nepali Saufi were recovered concealing

Learned counsel for the petitioner submits that, in fact, at the time of alleged recovery, petitioner was passing through the road situated near the place of occurrence, but mere on suspicion petitioner and other co-accused, Shiv Shankar Singh have been implicated in this case. It is further submitted that petitioner has no criminal antecedent and is in custody since 27.12.2017. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise Act, Sitamarhi, in connection with Sitamarhi P.S. Case No. 1119 of 2017. Out of two sureties, one surety must be the close relative of the petitioner.
