The petitioner seeks bail in a case registered for offences under Sections 272 and 273 of the Indian Penal Code and Sections 30 (A) and 38(i) of the Bihar Prohibition and Excise Act, 2016.

It is contended that as per allegation, 78 bottles each containing 180 ml, i.e. total 14.40 litres of foreign liquor were allegedly recovered from the toilet of one Shyam Babu Singh where it is said to be kept by the petitioner. It is further contended that the petitioner has been remanded in this case

Patna High Court Cr.Misc. No.39245 of 2017(2) dt.19-08-2017 2/2 from Sonbarsha P.S. Case No. 128 of 2017. Petitioner claims that he is in custody since 21.06.2017.

Considering the facts and the circumstances of the case, the petitioner, above named is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-I/c Special Judge, Excise Act, Sitamarhi in connection with Parsauni P.S. Case No. 15 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
