The petitioner seeks bail in a case registered for offences punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, 43.5 litres Nepali Saufi wine was recovered from a motorcycle which was being driven by the petitioner. However, pillion rider managed to escape from the spot. Petitioner claims that he is having clean antecedent and is in custody since 20.01.2018. Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten
Patna High Court Cr.Misc. No.20213 of 2018(2) dt.19-04-2018 2/2 Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge 4th -cum-Special Judge Excise, East Champaran, Motihari in connection with Excise Case No.34 of 2018.
Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
