Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 120B of the Indian Penal Code and Section 27 of the Arms Act.
According to FIR, three unknown persons thrashed the deceased on the ground and co-accused Vijay Yadav fired 4 to 5 rounds causing his instant death. Submission is that the impugned order would reveal that during investigation some witnesses named the petitioner also. If the petitioner who is co-villager of the informant was there, there was no reason to not disclose his name in the First Information Report.
Finding substance in the aforesaid submission, let
Patna High Court Cr.Misc. No.19861 of 2018 (2) dt.12-04-2018 2/2 the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Hasanpur Police Station Case No. 207 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
