The petitioner apprehends his arrest in a case registered for the offence under Sections 420, 402, 34 of the Indian Penal Code.

It is alleged that Rs. 10 lacs was given to the petitioner to construct the premises of primary school, but till date same has not been completed.

It is submitted on behalf of petitioner that petitioner has already completed the building of primary school and utilised the total sanctioned amount. In support of the same, he has annexed Annexure - 2 to the petitioner, which is an office order, contained in Memo No. 540 dated 18.02.2017, issued under the signature of District Programme Officer (Establishment), Madhubani clearly stating that work has already been completed. Even, Block Education Officer,

Patna High Court CR. MISC. No.15654 of 2023(2) dt.18-05-2023 2/2 Phulparas, after verification, found the work complete, vide letter no. 176 dated 04.05.2019 (Annexure 3). Petitioner has got clean antecedent.

Considering the same, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - II, Jhanjharpur, District - Madhubani in connection with Phulparas P.S. Case No. 215 of 2016, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay/- U T
