Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 17-11-2021 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners seek regular bail in connection with Dip Nagar (Nalanda) P.S. Case No. 421 of 2020 instituted for the offences under Sections 304(B), 201, 34 and 120(B) of the Indian Penal Code.

Learned counsel for the petitioners submits that both the petitioners are in custody since 07.12.2020, charge-sheet has been submitted in the case and the petitioners are persons with clean antecedent. It is further submitted that both these petitioners are cousin relative of the husband of the deceased and as such are not concerned in any manner with the family

Patna High Court CR. MISC. No.25678 of 2021(2) dt.17-11-2021 2/2 matters. Learned counsel fairly submits that no doubt the informant's daughter has died but then the present petitioners being distant relative have been roped in only because it was they who had informed.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioners.

Considering the fact that the petitioners are in custody since 07.12.2020, charge-sheet has been submitted in the case and they are not immediate relatives of the husband of the deceased, let the petitioners above named be released on bail on furnishing of bail bond of Rs. 10,000/- (Rupees Ten Thousand only) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Nalanda in connection with Dip Nagar (Nalanda) P.S. Case No. 421 of 2020 subject to the condition as laid down under Section 437 (3) Cr.P.C. (Satyavrat Verma, J) Rishi/- U T
