Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 302, 120B, 386 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is a woman and has been falsely implicated in the instant case by the informant out of malice and based on suspicion. The learned counsel submits that informant is the son of the deceased and he instituted the instant FIR against his brothers, mother and other accused persons, including the petitioner, who is daughter-inlaw of the deceased. It is further submitted that from perusal of the allegations as alleged in the FIR, it would manifest that

No.17021 of 2024(2) dt.04-04-2024 2/2 informant is not an eyewitness to the occurrence and his father was shot dead, and on account of dispute relating to property, the entire family members have been implicated with general and omnibus allegations. It is further submitted that the petitioner will not abscond rather will cooperate in the investigation.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of her arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Kumarkhand (Bhatni O.P) P.S. Case No. 445 of 2022, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) SUMIT/- U T
