JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 31-05-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners apprehend their arrest in relation to Triveniganj P.S. Case No. 278 of 2015 registered under Sections 147, 341, 323,324, 307, 379 and 504 of the Indian Penal Code. From reading of the F.I.R. and the order of the learned Sessions Judge, Supaul, it is apparent that there has been free fight between the parties, in which injuries have been occurred. Prima facie, it is not a case under section 307 of the Indian Penal Code.

No.14430 of 2016 (3) dt.31-05-2016 2/2 Be that as it may, in the event of their arrest/surrender before the court below within four weeks, let the above named petitioners be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of A.C.J.M., 1st, Supaul, in connection with Triveniganj P.S. Case No. 278 of 2015, subject to conditions laid down under Section 438(2) of the Code of Criminal Procedure.
