JUSTICE BIRENDRA KUMAR ORAL ORDER 11-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offence punishable under Section 392/34 of the Indian Penal Code.

F.I.R. of robbery is against unknown. Name of the petitioner surfaced in the confessional statement of co-accused Amka Kumar @ Musu, who has already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No.18708 of 2017. Submission of the learned counsel for the petitioner is that nothing was recovered from the possession of the petitioner nor the petitioner has been put on Test Identification Parade nor he has got any criminal antecedent.

No.30288 of 2017 (2) dt.11-07-2017 2/2 Considering the aforesaid submission, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sherghati, Gaya/Successor Court, in connection with Roshanganj P.S. Case No.87 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
