JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 504 and 353 of the Indian Penal Code. It is alleged that the informant being the Sub-Inspector of Police while checking the vehicles stopped a Pulsar motorcycle bearing registration no. BR9G-2870 and directed to produce the relevant paper, when protest being made 50-60 persons formed the mob and pelted stones as a result the police personals received injuries and the vehicle of the informant also got damaged.

It is submitted by learned counsel for the petitioner that the FIR has been registered against a bike and 50-60 unknown persons. Subsequently, the petitioner claimed the vehicle in question then he has been implicated in the present case. There is nothing on record to identify the petitioner. The

Patna High Court Cr.Misc. No.9496 of 2015 (2) dt.21-04-2015 2/2 FIR suggests that a red color Pulsar bike was intercepted whereas the petitioner's bike is of blue color. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the nature of accusation, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Town P.S. Case No.377 of 2012, subject to the conditions as laid down under Section 438(2) Cr.P.C.

The bail bond of the petitioner will be accepted on filing of the affidavit by the petitioner before the learned court below to the effect that they will regularly co-operate in the investigation. Non-cooperation in the investigation by the petitioner will give liberty to the learned court below to cancel the bail bonds of the petitioner.
